These Terms of Service ("Terms") govern your access to and use of www.thenamethatsells.com(the "Site") operated on behalf of Nik Poulimenos / Corcoran Horizon Realty ("we," "us," or "our").

By accessing or using the Site — including browsing listings, creating an account, or submitting a contact form — you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Site.

• Listing Content — property listings, photographs, descriptions, prices, and related MLS® data displayed on the Site;
• IDX — Internet Data Exchange program allowing display of active listing data to the public under board rules;
• VOW — Virtual Office Website program allowing display of certain sold/historical data to registered consumers under stricter rules;
• User — any visitor or registered account holder.

This Site displays Listing Content licensed from TRREB and, where applicable, CREA's Data Distribution Facility (DDF®) framework. We are not affiliated with, endorsed by, or acting on behalf of CREA or any local real estate board except as a licensed participant displaying data under applicable agreements.

Board rules require brokerage identification with listings, CREA trademark attribution on each page, and restrictions on advertising within listing displays. We comply with these display requirements to the extent they apply to this Site.

Listing Content is provided by participating brokerages and boards. While we strive for accuracy, information — including price, status, square footage, taxes, and availability — may change without notice and may contain errors. You must independently verify all information before making any decision.

Sold prices, days on market, and historical data may be subject to delay, rounding, or board-specific display rules. Estimates, market statistics, and automated valuations on the Site are informational only and are not appraisals or professional advice.

Public visitors may browse active (IDX) listings subject to board rules. Certain sold data, full addresses, or detailed history (VOW content) may only be available after you register for an account and agree to applicable terms. We may gate content based on listing permission flags, your registration status, and phone verification.

You may not scrape, bulk download, frame, or redistribute Listing Content. Automated access (bots, spiders) is prohibited except as expressly authorized by the board and CREA.

If you create an account, you agree to provide accurate information, keep credentials confidential, and notify us of unauthorized use. We may suspend or terminate accounts that violate these Terms or board rules.

Phone verification may be required to access certain features. Standard message and data rates may apply to verification SMS.

When you submit our contact form and opt in, you consent to receive calls, emails, and text messages from Corcoran Horizon Realty regarding real estate services, as described in our Privacy Policy.

You may opt out of marketing texts by replying STOP and of marketing emails via unsubscribe links. Message frequency may vary. Message and data rates may apply.

You agree not to:

• Use the Site for any unlawful purpose;
• Harass, impersonate, or mislead others;
• Interfere with Site security or attempt unauthorized access;
• Copy, scrape, or commercially exploit Listing Content without permission;
• Circumvent listing gates, board restrictions, or rate limits;
• Upload malware or harmful code.

Site design, branding, software, and original content are owned by Corcoran Horizon Realty, Valery Technologies Inc., or licensors. Listing Content is owned by the respective listing brokerages and boards and is displayed under license. You receive a limited, revocable licence to view Listing Content for personal, non-commercial use only.

The Site may link to third-party websites (e.g., mortgage tools, maps, social media). We are not responsible for third-party content or privacy practices. Your use of third-party services is at your own risk.

THE SITE AND ALL LISTING CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

Nik Poulimenos is a licensed real estate professional in Ontario. Nothing on this Site constitutes legal, tax, financial, or investment advice. Consult qualified professionals before making decisions.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Corcoran Horizon Realty,Nik Poulimenos, Valery Technologies Inc., AND THEIR RESPECTIVE DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR RELIANCE ON LISTING CONTENT.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED CANADIAN DOLLARS (CAD $100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Corcoran Horizon Realty and Valery Technologies Inc. from claims arising from your misuse of the Site, violation of these Terms, or infringement of third-party rights.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You attorn to the courts of Ontario for disputes, subject to mandatory consumer protections in your province of residence.

We may modify these Terms at any time. Updated Terms will be posted on this page with a revised date. Continued use after changes constitutes acceptance.
